On June 2nd, 2020, a little over half a year ago, I bought a Huawei Y6 2019 Sapphire Blue smartphone. It started spinning about 3 weeks ago. It always went off on its own, did not always react as desired to touch and at times did not work.

So I gave it to my shop for repairs 2 weeks ago, who sent it to the manufacturer. Today it came back as a package with the following repair description:

Device not repaired back Item was not repaired! The circuit board of the device is irreparably defective. The device could not be repaired under warranty.

My question now is: Since I still have a warranty claim, does the seller have to give me an equivalent replacement device or am I not entitled to it?

Guarantee is a voluntary service, so it can't be said in general terms, you would have to look at the terms and conditions or the guarantee provisions.

"The device could not be repaired under warranty." Why not?

The sentence can mean 2 things, a repair is more expensive, like a new device, in which case you are entitled to an exchange or money back or that is damage caused by yourself (which is unlikely with a circuit board) which the guarantee does not cover and so you were unlucky.

So clarify that with the seller.

Br

No, he doesn't have to provide you with a replacement device.
As it stands, the manufacturer is of the opinion that the damage is not covered by the guarantee and the damage is based on improper use.

Au

No, you are entitled to have the damage repaired / removed.

It is not really denied that it is a guarantee case. It's just there because it can't be repaired.

Of course, the guarantee can't be refused because the device is defective.

am I entitled to a replacement device?

Unless there's damage due to improper use, i.e. In particular no damage to the housing, yes. If it is mechanical damage, however, no.
