Exactly one week ago I bought the Huawei Y6 (2019) for 150 euro at Real. On the website of Huawei, the phone is called, equipped for outstanding performance ", which has only really moved me to buy the phone, because I like to play one or the other game on the phone.

But now it is so that the phone does not have an outstanding performance at all (especially at 150 euro price) and only slightly graphic-intensive games are barely playable, although I, as a buyer, understand that with a mobile phone, which is titled as "equipped for outstanding performance", such games should already be able to play.

The problem is that Real of course does not want to take the phone back, because the pack of the phone has already been opened (how do you know otherwise, if the performance of the device is good enough) and if I turn to the manufacturer Huawei itself, who has indeed made the wrong advertising promise, I'm told I should contact Real.

Now my question:

Am I not entitled, insofar as this is a misleading commercial act under Section 5 of the Law against Unfair Competition (which I assume), a right of reproduction and, if so, to whom can I assert this right of reproduction?

You should be aware that with a 150 euro mobile phone you will not get the same performance as with a 1000 euro mobile phone

"equipped for outstanding performance" says absolutely nothing about the actual performance: for some it is an absolute disaster, for the others it is OK and for others it is absolutely fine and perfectly adequate, otherwise it would be, if there are technical data and that are not kept

is a relatively vague term. Considering the price, the performance of comparable devices is likely to be acceptable.

Conclusion: Legally there's no handle. Research in detail before next.
