I have a mobile phone contract with 1&1 since march 2019 until march 2021. Now the mobile phone has only permanent problems. Touchscreen is off and on and much more now he doesn't even recognize headphones 1&1 said they could offer me the exchange service but that would My contract would be extended by 12 months and will be more expensive. You can no longer offer me the cell phone I have now, but instead of the Huawei P20 lite which I own, the Huawei P30 or a worse one than what I have now. But I want exactly the huawei p20lite and not the p30 because I don't like it visually and it's even bigger. Can I cancel the contract? Since I want to have the contract cell phone new and no other what is the legal situation.

Do you have a warranty on the device, contact the manufacturer or give HUAWEI only one year?

ca

Usually 24 months right?

le

You are in the area where you can choose a cheaper cell phone, if you do not want to have it, pay for it at the regular price.

oh yes, your contract has already been extended by 1 year; if you take a cell phone, the contract is extended for another 2 years

Exchange is something other than your dream phone

You have to know Apple has only 12 months and Microsoft only gives 12 months for the Xbox controller.

I do not understand. My contract runs until march 2021 if i take the p30 the contract runs until 2022 march

ca

I don't want a p30 or worse but the same as for which I signed the contract. What options do I have

le

You have probably got 1 contract and the mobile phone cheaper, one has nothing to do with the other, has to be treated separately

Paragraphs and punctuation marks, it's a pain to read.
Where is this a breach of contract? Have you ever guessed that DU damaged your smartphone due to bad use? And don't come now: "NEH I DON'T" You can't prove that to us and we can't exclude a page.
If you have the smartphone since 2019, you still have a 1 year warranty, therefore the shop that sold you the phone with the contract must ensure that this device is operational again BUT, YOU have to prove [reversal of the burden of proof] that you do not have the device operated or handled incorrectly, you can do that with an expert opinion, for example. Normally, a goodwill repair should be carried out or the dealer uses the manufacturer's guarantee. Maybe you should contact Huawei, which does not offer end customers support.

What prevents you from making a warranty claim with the manufacturer, provided the warranty runs for 24 months?

Whether and to what extent you are entitled to the same device as a replacement can be found in your contract with 1&1. But I assume that what you got there corresponds to the contractual conditions. 1&1's customer service is competent.
